Terms of Service

These Terms of Service (the “Terms”) set forth the terms and conditions governing the sale of products and use of services through the online store “ARCANIA” at https://arcania-official.com/ (the “Site”), operated by footstand (ARCANIA) (the “Shop,” “we,” “us,” or “our”).

Article 1. Scope

  1. These Terms apply to all relationships between customers and the Shop relating to the use of the Site and the purchase of products.

  2. Our Shipping Policy, Return and Refund Policy, Legal Notice, Privacy Policy, and any other policies posted on the Site form part of these Terms.

  3. If there is any inconsistency between these Terms and an individual policy governing a specific matter, the relevant individual policy will prevail with respect to that matter.

Article 2. Agreement to These Terms

  1. By purchasing a product through the Site or registering an account, you are deemed to have agreed to these Terms.

  2. If you are a minor, you must obtain the consent of a parent, guardian, or other legal representative before making a purchase through the Site.

Article 3. Accounts

  1. You may register an account using the method specified by the Shop.

  2. You are responsible for keeping your registration information accurate and up to date.

  3. You are responsible for properly managing your login information.

  4. The Shop may suspend or delete an account if the customer violates these Terms, fraudulent use is identified, or there is another reasonable basis for doing so.

  5. You may request deletion of your account using the method specified by the Shop.

Article 4. Orders and Formation of Contract

  1. Customers wishing to purchase a product must place an order using the method specified by the Shop.

  2. A sales contract is formed when the Shop accepts the customer’s order and notifies the customer of that acceptance.

  3. The Shop may, within reasonable limits, refuse an order or cancel a sales contract if any of the following applies:

    • The product is out of stock.
    • The order details or registration information contain an error or omission.
    • There is an obvious error in the displayed price, inventory status, or other product information.
    • Payment cannot be successfully completed.
    • Fraudulent ordering, resale fraud, unauthorized use of a third party’s payment method, or similar conduct is suspected.
    • The customer has previously committed a serious violation of these Terms.
    • There is another reasonable basis that makes it difficult for the Shop to accept or complete the order.
  4. If an order is canceled under the preceding paragraph, the Shop will notify the customer where appropriate and, if payment has already been received, process a refund within a reasonable period.

Article 5. Prices and Payment

  1. Product prices are displayed on each product page. Prices displayed for customers in Japan include consumption tax unless otherwise stated.

  2. Shipping fees and any other costs required for a purchase will be displayed on the applicable product page, at checkout, or in our Legal Notice.

  3. Available payment methods include credit cards and any other payment methods displayed at checkout.

  4. The timing and conditions of payment are governed by the terms applicable to the selected payment method and our Legal Notice.

Article 6. Shipping

Shipping destinations, shipping fees, processing times, shipping methods, and other delivery conditions are governed by our Shipping Policy posted on the Site.

Article 7. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, defective products, shipping damage, and related matters are governed by our Return and Refund Policy posted on the Site.

Article 8. Product Characteristics

  1. Some ARCANIA products are made with natural wood or other natural materials. Products made with natural materials may vary from piece to piece in wood grain, color, tone, knots, patterns, texture, and other aspects of appearance. These normal variations are inherent characteristics of natural materials and are not considered product defects.

  2. Engraving and LED lighting may also vary in finish, color, brightness, or other characteristics within normal manufacturing tolerances.

  3. Product images displayed on the Site may appear different from the actual product in color or texture depending on the customer’s monitor, device, lighting, or other viewing conditions.

  4. As a general rule, returns or exchanges requested solely because of normal variations in natural materials or variations within acceptable manufacturing tolerances will not be accepted.

  5. Notwithstanding the preceding paragraph, if a product is damaged during shipping, has a manufacturing defect, is incorrect, or materially differs from the product description on the Site, we will handle the matter in accordance with our Return and Refund Policy.

Article 9. Intellectual Property Rights

  1. Copyrights, trademarks, design rights, and other intellectual property rights relating to text, images, videos, logos, graphics, product designs, and other content displayed on the Site belong to the Shop or their respective lawful owners.

  2. Except where permitted by applicable law, customers may not reproduce, republish, modify, distribute, or commercially use such content without the prior permission of the Shop or the relevant rights holder.

  3. Purchasing a product does not transfer any intellectual property rights relating to that product to the customer.

Article 10. Prohibited Acts

When using the Site, customers must not engage in any of the following:

  • Conduct that violates applicable laws, regulations, or public order and morals.
  • Conduct that infringes the copyrights, trademarks, privacy rights, or other rights or interests of the Shop or any third party.
  • Providing false information.
  • Impersonating another person.
  • Using unauthorized payment methods or purchasing products through fraudulent means.
  • Placing an excessive burden on the Site, servers, or networks.
  • Unauthorized access, alteration of information, or other conduct that interferes with the operation of the Site.
  • Any other conduct reasonably determined to be inappropriate in light of the purpose of these Terms.

Article 11. Provision of the Site

  1. The Shop will make reasonable efforts to ensure the accuracy of product information and other content displayed on the Site.

  2. The Shop may temporarily suspend or discontinue all or part of the Site due to system maintenance, communication failures, natural disasters, unauthorized access by third parties, or other unavoidable circumstances.

  3. If a customer suffers damage as a result of the suspension or discontinuation of the Site, the Shop will be responsible only where the Shop is legally responsible, subject to the provisions of the following Article.

  4. If a dispute arises between a customer and a third party due to the customer’s conduct, the customer will resolve the dispute at their own responsibility and expense, except where the Shop is responsible for the dispute.

Article 12. Limitation of Liability

  1. If a customer suffers damage due to the Shop’s ordinary negligence, the Shop will be liable for actual, ordinary, and direct damages, and the maximum amount of such liability will be limited to the amount paid by the customer to the Shop for the transaction giving rise to the damage.

  2. The limitation in the preceding paragraph will not apply where the Shop has acted intentionally or with gross negligence, or where applicable law does not permit the Shop’s liability to be limited.

Article 13. Changes to These Terms

  1. The Shop may revise these Terms if either of the following applies:
    • The revision is consistent with the general interests of customers.
    • The revision does not conflict with the purpose of these Terms and is reasonable in light of the necessity of the revision, the appropriateness of the revised provisions, and other relevant circumstances.

  2. If the Shop revises these Terms, we will notify customers of the revised Terms and their effective date by posting them on the Site or by another appropriate method before the effective date.

  3. The revised Terms will apply from the effective date stated in the notice described above.

  4. Unless otherwise permitted by applicable law or separately agreed with the customer, a sales contract formed before the effective date of revised Terms will remain subject to the Terms in effect when that contract was formed.

Article 14. Governing Law and Jurisdiction

  1. These Terms are governed by and construed in accordance with the laws of Japan.

  2. If a dispute arises in connection with the use of the Site or the purchase of products, the court having jurisdiction under applicable law will have jurisdiction as the court of first instance.

Article 15. Severability

If any provision of these Terms, or any part of a provision, is determined to be invalid or unenforceable under applicable law, the remaining provisions and any valid portion of the affected provision will remain in full force and effect.
